SIGNIFICANT JURY VERDICTS AND SUMMARY JUDGMENTS
Defense Verdict in Lucas County Common Pleas Court (Toledo, Ohio) in lawsuit stemming from a motor vehicle accident with disputed injury claims. Two plaintiffs claimed damages consisting primarily of chiropractic treatment resulting from direct telephone solicitation following the accident. Following a unanimous jury verdict, the trial judge awarded plaintiffs their ER bills based on undisputed reasonableness.
Summary Judgment in Marion County, Indiana Circuit Court (Indianapolis, Indiana) in favor of privately-owned casino in lawsuit stemming from a patron’s eviction for counting cards while gambling. Plaintiff asserted a theory of breach of contract and also sought a declaratory judgment the casino’s actions were not proper, but did not claim any discrimination. Summary Judgment granted based upon the casino’s right as a privately-owned place of amusement to refuse the business of any prospective patron for any reason, or no reason.
